Misdemeanor vs Felony Charges in NJ

Our founding partner, Michael J. Montanari, ESQ explains the definitions of Misdemeanors and Felonies according to New Jersey law, and the proper process they should follow either in Municipal Court or Superior Court instances accordingly.

Most people when they know about Criminal Law, they hear from TV. When they hear misdemeanors or felonies that is what they know as criminal Law. In New Jersey, we don´t classify the cases as misdemeanors or felonies. Our misdemeanors or disorderly persons matters which are heard at Municipal Court, (local town courts) which are heard by an appointed judge with no jury. Our felonies are considered indictable offenses which are heard at the county level and are heard by Superior Court Judges, and at times most likely, you are entitled to adjourn.
